It is important that you carefully read these Terms and Conditions for ‘Access! Business English’, the trading name of Kieron Heath, a sole trader located in Bedford, United Kingdom. Hereinafter, ‘Access! Business English’ is referred to as ‘the company’ and if you are not willing to accept our Terms and Conditions, please refrain immediately from using our website and associated materials.

In addition, please read our ‘Privacy Policy’ which applies to our collection and use of your personal information in relation to our website. People who register with us are also bound by the Terms and Conditions agreed to during account creation.

We may change these Terms and Conditions from time to time by updating this page. You should review this page regularly. Your continued use of our website after changes have been made will be taken to indicate that you have read and accepted those changes. 1.a. You agree to use our website only in accordance with these Terms and Conditions, the Terms and Conditions agreed during your account creation with the company, for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of our website.

1.b. Prohibited behaviour includes, but is not limited to, harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website or impersonating another person, for example, by using their login details to access the pages of our website.

The company does not operate or monitor other websites and we accept no responsibility or liability for the content of other websites. 4.d. Should we link to other websites, it is your responsibility to check the terms and conditions and privacy policy on any other website that you visit.

4.e. Should any part of the company’s courses function improperly, the company will take steps to remedy the situation as soon as possible. Once a course or courses have been purchased, the company policy is not to refund the cost of such a course, but the company is willing to offer a one-off Mini Course on a complimentary basis.

5. LIABILITY

5.a. We do not guarantee that:

use of our website will be compatible with all hardware and software

use of our website will be uninterrupted or error or virus free

use of our website will deliver any specific outcome for its users

defects on our website will be corrected, save for those defects which the company is obliged to correct by law

5.b. You must take appropriate steps to ensure that you regularly check for and protect against viruses when using our website on any device.

5.c. We make no statement about the suitability of the content, information and services contained on, or accessed via, our website. All warranties, terms and conditions in this regard, including all warranties, terms and conditions implied by statute or otherwise, of satisfactory quality and fitness for purpose are excluded to the fullest extent permitted by law – please see directly below for more details. You should not send any communication to us through our website or by email, in particular which contains personal data (including sensitive personal data) and/or confidential information about you or any other person, unless you accept that any such communication would be sent at your own risk and on the understanding that we would not be liable for any loss that you might suffer as a result, except for losses which cannot be excluded or limited at law, as referred to directly above.

5.h. Regarding videos in the course modules, the company often includes hyperlinks to various relevant videos which are accessible on YouTube or on the websites of other third-party video producers. In order to respect and protect the copyright of video producers, suppliers and publishers, the company is not legally permitted to embed such videos on its website. Clients of the company, and viewers browsing the company’s website, must also respect and comply with the copyright obligations of YouTube, the producers and owners of all such videos posted thereon, in addition to all other videos accessible through Access! Business English’s website from other sources and providers on the internet. Whilst the company is legally permitted to include third-party URL hyperlinks on its website, the company cannot fully guarantee that these hyperlinked videos will always be available online, in which case the company requests that it be informed as soon as possible so that it can offer an alternative replacement in addition to a complimentary Mini Course.

5.i. Regarding other media including audio recordings, articles and texts on the company’s website, or contained in any other materials produced by the company, clients and any viewers of all such materials must legally comply with the copyright requirements of each item.
